Commercial disputes in Ireland, North and South, are finding settlement both easier and less expensive using alternative dispute resolution. CMCS offers a facility to expedite the process of selection of a mediator/conciliator from a list of appropriately qualified professionals.
Conciliation and Mediation are consensual non binding processes which allow commercial entities in dispute to find a solution to the problem between them without the expense of going to arbitration or the courts. Mediation is a pure attempt to resolve issues by consensus. There must be a real commitment to overcome misunderstanding and seek an accommodation. Conciliation is a very similar process but the conciliator is required, if agreement cannot be reached, to provide his opinion on the right answer. This often gives parties the confidence to go the final step to a real agreement.
Conciliation and mediation are less expensive than arbitration and litigation. It is usually much faster and frequently the consensual approach allows the parties to maintain (or salvage) their commercial relationship. |
